LIMITED CYBER EXTENSION No. 2
(For use in conjunction with Contingency Risks)
1. Notwithstanding any provision to the contrary within this Contract of Insurance, this Contract
of Insurance is extended to indemnify the Insured for their Ascertained Net Loss should the
Insured Event(s) be necessarily Cancelled, Abandoned, Curtailed, Interrupted, Postponed or
Relocated as a sole and direct result of a Cyber Incident affecting the Insured or any
Participant, subject to all the terms, conditions, limitations and exclusions of this Contract of
Insurance or any endorsement thereto.
2. Notwithstanding paragraph 1, this Contract of Insurance excludes any Cyber Incident which is
caused by, contributed to by, resulting from, arising out of or in connection with:
2.1. a Cyber Act including, but not limited to, any action taken in controlling, preventing,
suppressing or remediating any Cyber Act or the fear or threat of any Cyber Act; or
2.2. any Computer System owned or operated by any party other than the Insured or any
Participant; or
2.3. any failure or interruption to third-party infrastructure or service provider, including
telecommunications, internet service, satellite, cable, electricity, gas, water or other
utility service providers unless such infrastructure is under the direct operational control
of the Insured.
DEFINITIONS
3. Cyber Act means an unauthorised, malicious or criminal act or series of related unauthorised,
malicious or criminal acts regardless of time and place, involving access to, processing of, use
of or operation of any Computer System.
4. Cyber Incident means:
4.1. any error or omission or series of related errors or omissions involving access to,
processing of, use of or operation of any Computer System; or
4.2. any partial or total unavailability or failure or series of related partial or total
unavailability or failures to access, process, use or operate any Computer System.
5. Computer System means any:
5.1. computer, hardware, software, communications system, electronic device (including,
but not limited to, smart phone, laptop, tablet, wearable device), server, cloud or
microcontroller including any similar system or any configuration of the aforementioned
and including any associated input, output, data storage device, networking equipment
or back up facility;
owned or operated by the Insured or any other party.
ALL OTHER TERMS AND CONDITIONS REMAIN UNCHANGED
